By downloading, installing, or using the Fairy Tales: Baby Stories mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
Fairy Tales: Baby Stories is a mobile application that provides:
- AI-generated personalized fairy tales for children
- Text-to-speech narration of stories
- Multiple voice options for story narration
- Profile management for multiple children
- Story favorites and listening history
- Age-appropriate content recommendations
3. User Accounts
3.1 Anonymous Authentication
- The App uses anonymous authentication to provide service
- No email or personal identification is required to use basic features
- User data is associated with an anonymous user ID
3.2 Profile Management
- Users can create up to 4 child profiles per account
- Each profile includes: child's name, age, and avatar selection
- Profile information is stored securely on our servers
3.3 Account Deletion
- Users can delete their account at any time through Settings
- Account deletion permanently removes all user data, profiles, and created stories
- This action cannot be undone
4. Subscription and Payments
4.1 In-App Purchases
- The App offers in-app purchases for premium features
- All purchases are processed through Apple's App Store
- Prices are displayed in your local currency
4.2 Subscriptions
- Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- Subscriptions may be managed and auto-renewal may be turned off in your App Store Account Settings
4.3 Refunds
- Refund requests are handled by Apple according to their policies
- Contact Apple Support for refund inquiries
5. User Content
5.1 Story Generation
- Users can create custom stories by providing story parameters
- AI-generated stories are created based on user input
- Users retain ownership of their custom-created stories
5.2 Content Storage
- Created stories and user preferences are stored on our servers
- We reserve the right to remove content that violates these Terms
5.3 Prohibited Content
Users may not create or request stories that:
- Contain violent, harmful, or inappropriate content for children
- Violate any applicable laws or regulations
- Infringe on third-party rights
6. Intellectual Property
6.1 App Ownership
- The App, including its design, features, and functionality, is owned by tomx.co
- All trademarks, logos, and service marks are our property
6.2 AI-Generated Content
- AI-generated stories are created using third-party AI services
- Users have a non-exclusive license to use their generated stories for personal use
- We retain the right to use anonymized story data to improve our services
6.3 Voice Content
- Voice narrations are generated using text-to-speech technology
- Voice samples and narrations are licensed for use within the App only
7. Privacy and Data Collection
7.1 Data Collection
We collect and process:
- Profile information (child's name, age, avatar selection)
- Story preferences and listening history
- Usage analytics and app performance data
- Device information for service improvement
7.2 Third-Party Services
The App uses:
- Supabase for data storage and authentication
- Replicate AI for story generation
- Third-party text-to-speech services
- Analytics services for app improvement

8. Age Restrictions
8.1 Parental Consent
- The App is designed for children but must be set up by a parent or guardian
- Parents/guardians are responsible for monitoring their child's use of the App
- By creating a child profile, you confirm you are the parent or legal guardian
8.2 COPPA Compliance
- We do not knowingly collect personal information from children under 13
- All data collection is performed with parental consent through the account setup process
9. Disclaimers and Limitations of Liability
9.1 Service Availability
- We strive to provide uninterrupted service but do not guarantee 100% uptime
- The App may be temporarily unavailable due to maintenance or technical issues
9.2 AI-Generated Content
- AI-generated stories are provided "as is"
- We do not guarantee the accuracy, quality, or appropriateness of all AI-generated content
- Parents should review stories before sharing with children
9.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount paid by you in the past 12 months
- We are not responsible for third-party service failures
10. Termination
10.1 By User
- You may terminate your account at any time through the Settings menu
- Account deletion is immediate and permanent
10.2 By Us
We may suspend or terminate your account if:
- You violate these Terms
- You engage in fraudulent or illegal activity
- Your account is inactive for an extended period
11. Changes to Terms
- We may update these Terms from time to time
- Continued use of the App after changes constitutes acceptance
- Material changes will be notified through the App
12. Governing Law
- These Terms are governed by the laws of Turkey
- Any disputes shall be resolved in the courts of Istanbul, Turkey
